| Bar asks govt, to fill vacancies in Judiciary | | Eighty Thousand Cases Pending in High Court | | Early Times Report
Srinagar, Feb 16 : The Jammu and Kashmir High court Bar Association has deeply expressed its concern over the non-availability of full quorum of Judges in the High Court of Jammu and Kashmir and in subordinate judiciary which is resulting in a huge backlog of cases pending for consideration before the courts. More than Eighty Thousand cases are pending before the Hon'ble High court, which remain unattended for want of availability of judges. The HCBA has taken up the matter with the Chief Justice of High Court thereby pressing the demand to fill up the available vacancies particularly in the High court of J&K at Srinagar as at present only six judges are in the High Court as against the full quorum of 14 Judges.
The Bar Association is astonished as to why the available vacancies at High Court are not filled up despite the fact the Supreme court of India as well as the law commission of India is of the opinion that the vacancies in the High courts should be filled up to cater the needs for dispensation of justice at the earliest. In Jammu and Kashmir a number of judges have retired past two years and the vacancies are still vacant. It is pertinent to mention here that while making alleviation to the benches the Kashmir Bar Association is not given due representation to which it merits while making alleviation to the benches from lawyers quota and the Kashmiri lawyers have been ignored from consideration and Kashmiris are as such subjected to unjustified and patent discrimination.
According to KNS the Bar Association urges that the vacancies in the Hon'ble high court be filled up to cater the needs for dispensation of justice and while making alleviation to the benches the Kashmir Bar Association be accorded due consideration and proper representation. The non-availability of the proper quorum in the Hon'ble High Court is resulting in pendency of cases without hearing and the delayed justice in habeas corpus matters especially amounts to denial of justice which is a serious cause of concern in all relevant circles.
