VOJ books RC (M) for causing wrongful loss to Govt | | | early times report Jammu, Feb 17: Vigilance Organziation Jammu today booked Vinod Koul Relief Commissioner (Migrants) Jammu and M/S Maytas Rithwik (joint Venture firm) u/s 5(1) (d) r/w section 5(2) J&K PC Act 2006 w/w section 120-B RPC for causing wrongful loss to the Govt exchequer to tune of Rs 2, 03, 18, 155/- amount and wrongful gain to himself and private firm. According to Fir No 3/2012 a verification conducted into the matter relating to allegations of payment of service tax out of Govt exchequer by the office of Relief Commission (Migrant) Jammu has revealed that Vinod Koul Relief Commissioner (M) Jammu entered into criminal conspiracy with M/S Mytas Rithwik and in pursuance thereof Vinod Koul dishonestly, fraudulently and by abusing his official position made a pyment in respect of service tax to the tune of Rs 2, 03, 18, 155/- out of Govt exchequer whereas the same was to be deducted from the running bills of aforesaid firm submitted in the office of Relief Commission (Migrant) Jammu on account of work executed for construction of two rooms tenements at Jagti Nagrota, Jammu thereby causing wrongful loss to the tune of Rs 2, 03, 18, 155/- to the Govt exchequer and corresponding wrongful gain to the accused firm. It has been further revealed that work of construction of two rooms tenements for migrants of Kashmir Valley at Jagti Nagrota Jammu was awarded in favour of M/S Mytas Rithwik in the year 2007 and as per terms and conditions of the NIT, service tax among other taxes was to be paid after deducting the same from running bills of the contractor at the rate applicable at the relevant time. The rate of service tax was 8.4% between the period 2007 till March 31, 2010 and the same was revised @ 10.5% w.e.f. April 1, 2010. The Verification further revealed that Vinod Koul Relief Commissioner (Migrants) Jammu with dishonest intention and by abusing his official position deducted service tax from the running bills of contractor @ 8.4% only even after April 1, 2010 and paid remaining 2.1% to service tax dept from the money drawn from the Govt exchequer earmarked for Jagti Project thereby causing wrongful loss to the Govt exchequer to the tune of 2, 03, 18, 155/- to himself and private firm and register case and started investigation.
