Is Rana, Gul giving constitutionally 'illegal' advice to Omar | | | Early Times Report Jammu, Feb 17: The State Accountability Commission by terming ministerial status to Mubarak Gul and Devinder Singh Rana as constitutionally untenable has served a blow to Omar Abdullah government. The observation by the Commission that any appointment by the government in the interest of the affairs of the State can only be made by either Governor or by the Legislature and not by mere government order has exposed how ministerial status are awarded for political considerations rather than by the rule. Going by the observation of the Commission as it appears and stands clear that rules of governance have been thrown to winds. The person enjoying the status of a minister is a member of the executive branch entrusted with the job of governance and in framing and executive rules in the interest of affairs of the State. Even though the Commission has ordered an inquiry and government file reply but as things stand today any advice on governance by the two two advisers of the CM, including Rana, termed as de-facto CM, is constitutionally not tenable. The government acts and abides by the rules and the Constitution. By acting on whims and facies the present government has only mastered the art of bending and mending rules for granting favour or for settleling political scroe. This order of SAC seen in the light of recent reported statement of PHE minister Taj Mohi-ud-din that why Abdul Gani Vakil has been given ministerial bunglows in both Srinagar and Jammu when he is indulging in Cong bashing, clearly reflects how governance is being carried on by the chief minister for his 'personal consideration' and not in the interest of the State. Going by the observation of the Commission and if in the final outcome it quashes these appointment then all such advice given by his advisors would be also termed as a illegal and constitutional. And if that happens then if would be not only big blow to the Government but also to the people who were being ruled by such advice in all these years. |
