10 IPS officers of J&K yet to submit IPRs, union home ministry mulls action

Jammu, Feb 21: Despite repeated warnings issued by the Union Ministry of Home Affairs, 10 IPS officers of Jammu and Kashmir cadre are yet to submit their Immoveable property return (APRs) statements for the year 2010.
These include Vinay Kumar Singh (1987), Abdul Qayoom Manhas (1994), Avtar Singh Bali (1996), Kastoori Lal Bhagat (1997), Abdul Hamid (1998), Uttam Chand (2002), Amit Kumar (2006), Neeva Jain (2008), Tejinder Singh (2008) and Udayabhaskar Billa (2008). Of these, Vinay Kumar Singh is on deputation, Abdul Qayoom Manhas is DIG (APHQ), Avtar Singh Bali is Director Telecommunication, Kastoori Lal Bhagat is DIG IRP and Abdul Hamid is Commandant Armed Battalion.
These police officers, according to MHA, have not declared their annual IPRs for 2010 despite three deadlines given to them by the home ministry. These officers have not submitted their IPRs despite being clearly told that non-submission would result in penalty being imposed upon them.
The decision to penalize IPS officers who do not submit their IPRs was taken by the Home Ministry after it was found that the property returns of 713 officers for the year 2010 (as on January 1, 2011) had not been received by the government. Home ministry has stated that the delinquent officers would be denied vigilance clearance. A vigilance clearance is mandatory for any officer to get a promotion or any other assignment - both within and outside the country.
After several reminders to the state government, the names of officers whose IPRs have not been received by the central government have been put on the MHA website. On November 4, 2011; Home Ministry had asked state governments to ensure that IPS officers in their cadre submit their IPRs by January 31, 2012. The ministry had shot off letters to the states saying every IPS officer is required to fill forms attached to their performance appraisal report and submit them.
While submitting their PARs, the IPS officers have been asked to submit property returns for 2011 as on January 1, 2012 to the state government by January 31. What to talk of submitting IPRs for the year 2011, these 10 officers have not submitted the details of their properties for the year 2010. A look at the updated website of Union Home Ministry explains all. Sources said that despite several reminders from the Union Home Ministry, state home department has failed to ensure compliance.
They added that of the ten officers who are yet to submit their APRs, five are fresh recruits. MHA had issued the last deadline to these police officers in September 2011, asking them to submit their annual IPR for 2010 before October 10 else their vigilance clearance may be denied for future postings. It also said names of defaulters would be made public on the ministry's website.
Circular issued by the home ministry has mentioned that if the IPRs for 2010 are not received within the aforesaid period, names of defaulting officers will be posted on the website of this ministry. Ministry, in its circular had also directed the officials to ensure that phrases such as same as previous years, no change or no addition should not be used in filing these returns and instead full particulars of immovable property (inherited/owned/acquired or held) should be furnished.
It needs to be mentioned here that every Indian Police Service (IPS) is required to fill Part II of the performance appraisal report, which is IPR and submit the same to the reporting authority. Simultaneously, he/she is required to submit the property return to the State Government concerned in a sealed cover and indicate the date of submission of the same in the relevant column of the PAR.
The PAR for 2011 is due to be submitted on or before Nov 1, 2012. "Unless the property returns are received by the central government, the record will not be complete and the central government has no option but to assume that the property return(s) had not been submitted,' sources added.
