On Gola's complaint, court asks SVO to verify allegations against DSP Kaith, ors | | | Early Times Report jammu, Feb 23: Anti-corruption special judge Pawan Dev Kotwal has directed SSP of state vigilance organisation (SVO) to verify the allegations of corruption as levelled by Ravinder Gupta alias Gola Shah against DSP ML Kaith and others. The court directive came today in a petition filed by Gola Shah, a real estate dealer, against Kaith, who at present is SDPO, Gandhi Nagar, Vikramjeet Singh alias Rooble, son of Dev Raj Singh of Gandhi Nagar, and others. In the petition, Gola has alleged that DSP and others had demanded Rs 8 lakh from him to set aside the cases registered against him at different police stations. Gola claimed that the cases were wrongly registered against him. He alleged that DSP Kaith had entered into a criminal conspiracy with Rooble to give undue benefit to the latter. That an illegal gratification of Rs 8 lakh had allegedly been demanded by the police officer is admitted by Rooble in the conversation recorded in a CD annexed with the complaint. Gola alleged that in abuse of his official position in pursuance to the criminal conspiracy, Kaith had lodged frivolous FIRs against him only to disposses him of a valuable chunk of land at Greater Kailash here. The DSP was alleged to have done so to deliver the possession of the said land to Rooble in lieu of graft agreed to be paid by him. The judge observed that in the given circumstances, the allegation of illegal gratification needed to be verified. Upon this, the court ordered that complaint in original along with annexure be sent to SVO SSP for verification of allegations to the extent of agreement or attempt to pay and receive illegal gratification by the accused and further necessary action under law. The court observed with a direction to the SSP that "even conducting of verification shall not influence the investigation conducted by Kaith or the proceedings in civil or criminal cases pending disposal in the court". The observations and order shall also not have any bearing on the entrustment of investigation to the DSP unless otherwise deemed proper by competent authorities. The court said that in case of any grievance of either of the parties with regard to such investigation or proceedings in different courts, parties were at liberty to seek redressal of their grievances from the competent courts and this order would not come in way of any action/ order taken or passed or to be taken or to be passed in such investigations or proceedings. |
