| Court awarded life-imprisonment to eight including then SSP | | Honour Killing- Nitin Murder case | | Early Times Report
Jammu, Feb 23: Principal Sessions Judge Jammu today awarded life-imprisonment and fine Rs 10,000 to then SSP Karnail Singh, seven others in much publicized honour killing caste in which one Nitin Sharma was killed by the accused persons and a case u/s 302, 364,120-B, 109 RPC stands registered in this case.
Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing Special PP Raghu Mehta for the State whereas Sr Adv Sunil Sethi, Adv OP Sharma and RS Jamwal for the accused persons observed that caste system is a curse on the nation and the sooner it is destroyed the better. "This is a free and democratic country, and once a person becomes a major he or she can marry whosoever he/she likes. If the parents of the boy or girl do not approve of such inter-caste or inter-religious marriage the maximum they can do is that they can cut off social relations with the son or the daughter, but they cannot give threats or commit or instigate acts of violence and cannot harass the person who undergoes such inter-caste or inter-religious marriage," court observed.
Court further observed the passion which raised an honour killing by the accused could have been prevented had the accused thought it peacefully, settled down the matter with the deceased and the daughter of accused Karnail Singh and Ratno Devi.
The accused Karnail Singh who was known to be a protector of the society has himself taken of the reign of the justice in his hands and inflicted such a treatment to the deceased which is unknown to the society and is not acceptable to the public at large. The act of the accused is such that it has shattered the conscious of the court. The deceased was kidnapped and the accused inflicted various injuries on the deceased and thereafter disposed of its body to a distant place making it a blind murder and awarded life-imprisonment and fine to all the accused namely Naresh Kumar, Sohan Lal, Jeet Kumar alias Jeeta, Jaimal Kumar alias Jeebu, Daleep Singh, Karnail Singh, Ratno Devi and Suresh Kumar.
After hearing the counsels Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal awarded life-imprisonment and fine Rs 10,000 to then SSP Karnail Singh son of Khazan Chand, Ratno Devi wife of Karnail Singh, Naresh Kumar son of Hans Raj, Sohan Lal alias Sonu alias Khand son of Amar Nath, Jeet Kumar alias Jeeta son of Thoru Ram, Jaimal Kumar alias Jeebu son of Sat Pal, Daleep Singh alias Lucky son of Puran Chand and Suresh Kumar son of Babu Ram who killed one Nitin Sharma.
According to the police case that Motive behind the elimination of the deceased Nitin Sharma a Brahmin boy, driver of matador, had developed illicit relations for 6/7 years with daughter of accused Ratno Devi and Karnail Singh SSP and ultimately illicit relations matured in their marriage on March 31, 2005 without obtained consent of her parents and had fled together but after some time returned back and was kept under strict vigil by her parents which once led her to jump from the roof top to meet her deceased lover husband that caused injuries to her both legs and was not able to walk for certain period. Irked by this development a deep rooted conspiracy was hatched to do away with Nitin Sharma who did not earlier surrender to various threats given to him and to the members of his family to disassociate himself with their daughter. On this animosity the accused in custody are that accused Karnail Singh, then SSP in 6th Bn IRP, Rajouri and his wife Ratno Devi made up their mind to do away with Nitin Sharma. The plan was hatched between Ratno Devi and Naresh Kumar at the residence of Ratno Devi situated at Langer at the behest of accused Karnail Singh, husband of accused Ratno Devi and it was decided that Naresh Kumar accused will be paid Rs.1.30 lacs in lieu of murder of Nitin Sharma. Though Naresh Kumar demanded rupee five lacs, however, the agreement reached was for Rs.1.30 lacs between him and Ratno Devi. Besides this Ratno Devi also promised Naresh Kumar of his regularization and serving him lavish party.
The accused Karnail Singh had also been threatening the parents of the deceased on telephone that he will do away with the deceased within one week. Naresh Kumar accused contacted the deceased on his mobile number from Chib Sales Corporation STD and called him near Dogra Academy. When the deceased reached there the accused forcibly put the deceased in the vehicle despite deceased strong resistance and took him to the residence of Karnail Singh situated at Langer and after torturing the deceased the accused at 10.30 PM took Nitin Sharma near Greater Kailash, Fountain Chowk, canal head. The accused with an intention to murder Nitin tied neck of the deceased with shoe lace and strangulated him with the help of Daleep Singh accused and accused Sohan Lal and Jeet Kumar were forcibly holding the deceased at that time. A cloth was also gagged in the mouth of the deceased so that he could not raise his voice. After this the deceased was beaten with baseball bat, which was brought by accused Sonu from the Kothi in order to ensure that the deceased in no way should survive. Thereafter his dead body was thrown in the canal. After completion of investigation presented challan against the accused Naresh Kumar, Sohan Lal, Jeet Kumar alias Jeeta, Jaimal Kumar alias Jeebu, Daleep Singh, Karnail Singh, Ratno Devi and Suresh Kumar.
