| HL Gupta Memorial | | | Jammu | Jan 20 Former Chief Justice of India and Former Chairperson of Human Rights Commission HL Gupta delivered HL Gupta memorial lecture for the year 2007 on "Judicial Activism and self Restraint" at Model Institute of Education and Research (MIER). The memorial lecture was presided over by his Excellency Lt. Gen. (Retd) S.K. Sinha, PVSM Hon'ble Government, Jammu and Kashmir State. Both the dignitaries were given warm reception by Dr. Arun K. Gupta Director, Dr. Renu Gupta Joint Director, Dr. S. Sapru, Registrar and other senior officers of MIER. Justice Anand while delivering the lecture remembered Late Prof. H.L. Gupta (1912-1983) whom he described as great son of soil, a teacher par excellence, a great educationist and above all a great human being. Speaking on topic "Judicial Activism and Self Restraint" he said that for the program of Nation, all the three coordinate organs of the State that is legislature, Executive and Judicary are to function in complete Harmony. The Judicial review has a more technical significance, as India has a written constitution. The Judicary provides the means by which mistakes committed by one are corrected by other. Function of Judiciary is not to set itself in opposition to policy and politics of majority rule, but to test the validity & constitutionality of state. The court neither approves nor condemns any legislature policy not it is concerned with its wisdom or expletively. There should be role of courts. The judiciary starts acting when some action is wrong. He also said that Judiciary must at in the parameter of constitution. People have great faith in Judges. Judiciary should act as a time keeper. It's like a gave of football the Judiciary should act as referee who have to decide what's going wrong or right. Dr. Anand summed up by saying that it is mainly the expanded role & particularly the expansion of jurisdictional limits of the courts exercising judicial review, which has been given the title of "Judical Activism" by those whose are critical of this expanded role of judiciary. Dr. A.S. Anand also formally launched the ALUMNI ASSOCIATION of Model Academy by releasing the Alumni database of school. Later his Excellency Lt. Gen (Retd) S.K. Sinha described late Prof. H.L. Gupta as a dedicated and foresighted educationist who had a dream of creating an excellent institute in State. Starting with mission of tiny schools in Jammu city in year 1936 which has now grown into an great complex known as model Institute of Education & Research (MIER). Gen. Sinha complimented Justice Anand for delivering a very informative lecture on a topic of great interest to country. He further said that it is up to the public to hold the majesty of rule of law as the judges must restraint in discharge of their judical functions in order to preserve credibility of the judical process. Dr. Arun K Gupta, Director MIER described Dr. Anand as a top luminary, a custodian of human rights and dignity, an accomplished author and a highly decorated son of the Dogra land. Dr. Gupta lauded the role of his Excellency Lt. Gen (Retd) S.K. Sinha PVSM, as a highly accomplished and decorated Soldier, Scholar & a Statesman.
