Jail supdtt, cop, Baba denied bail in supari killing case | | | early times report JAMMU, Feb 24: Second additional sessions judge Subash C Gupta today dismissed the bail applications filed by former jail superintendent Mirza Saleem Ahmed Beig, his PSO and cop Surinder Kumar and alleged criminal Sunny Baba who are facing trial in an alleged supari killing case. Rejecting the bail applications, he observed that the allegations against the accused were serious, heinous and grave in nature. Beig was himself involved in the hatching of the criminal conspiracy for committing murder, while he was superintendent of Kot-Bhalwal jail. He was supposed to take reformatory measures for the welfare of the undertrials and other prisoners. However, he developed intimacy with undertrial prisoners, such as Nagar Singh and Sunny Baba. He also took services of Surinder in the criminal activities. Arranging Baba as contract killer for Nagar to eliminate Sudershan Singh Wazir speaks of his criminal mentality. It is not expected from a man of such a stature to involve himself in the contract killing as done in the instant case. His presence in the meeting held in the month of August 2010 in the store of the shop of Surinder's brother could not be considered as innocuous and without any ulterior motive, the court observed. As desired by him in the said meeting that Baba had to perform the task assigned by Nagar was another incriminating circumstance, showing his involvement in the hatching of criminal conspiracy for contract killing. It is further in the proved allegations that in his presence, Rs 15 lakh were paid to Baba in the meeting for carrying out the killings. Consumption of Rs 20 lakh, which were earlier received as 'supari' by Beig and his PSO was another factor showing that the accused/petitioner was part of the aforesaid privy. There were further allegations that Baba, along with other accused, who were subsequently involved by another accused Jaggar Singh, tried twice to eliminate Sudershan Singh Wazir, while he visited marriage functions at Deva Palace at Preet Nagar and at City Palace, Bye-pass. Fortunately, he remained safe. Had Baba and other accused succeeded in killing Wazir, all the conspirators, including Beig, would have certainly been made liable for the commission of offences under sections 302 and 120-B of RPC.With these observations, the court dismissed the bail applications of the three accused.
