Charges framed against Yaseen, others in US dollar hawala scam | | | early times report JAMMU, Feb 24: Designated judge of TADA/POTA court, Sanjay Parihar today framed charges against JKLF's Mohammad Yaseen Malik, Mushtaq Ahmed and Shamima in the one lakh US dollar hawala scam. The charges were framed under section 3/22 of POTA. While Yaseen was present in the court, the other two could not come because of the closure of the national highway due to bad weather. The court heard the counsels for the accused and considered report and material collected during the course of investigation, including statements recorded under section 161 of CrPC, besides confessional statements of Mushtaq and Shamima recorded under section 32 (1) and under sub-section (5) of POTA. The court was of the conclusion that the material placed on record disclosed sufficient ground for presuming that the accused might have committed the offence under section 3/22 of POTA. The accused were therefore charged with the commission of offences under section 3/22 of POTA which were exclusively triable by this court, the judge said. According to the case, Yaseen, with intention to strengthen armed activity in J&K, raised funds to strike terror. In March 2002, JKLF convened a meeting at Srinagar in which Yaseen authorised Mushtaq to go to Kathmandu in Nepal and bring one lakh US dollars as the arrangement for the same had already been made. The money was to be distributed amongst different militant outfits engaged in the armed activity in J&K. Mushtaq and Shamima brought one lakh US dollars from Kathmandu to Delhi. They were on their way to Srinagar on March 24, 2002, in a tempo traveller when police had recovered 70,000 and 30,000 US dollars from Mushtaq and Shamima respectively at Kud.
