HC restrains sarpanch from operating funds | | | early times report JAMMU, Feb 25: High court judge, Justice J P Singh has issued a direction, restraining Sher Ali, sarpanch of 28-panchayat halqa, Kumate, in Ramban, from operating funds. The court directive came in a petition filed by one Lal Singh, who claimed to be elected sarpanch of Kumate. He said there were two tendered votes which could not be counted in terms of the provisions of J&K Panch-ayat Raj Act 1989. After hearing the counsel for the petitioner, Justice Singh issued notice to respondents for their response within two weeks. Looking to the nature of the issue projected in the writ petition, this petition needs to be heard for final determination at the hearing stage and parties are allowed two weeks time to complete their pleadings and called the election record from the returning officer as also the appellate authority informing the CEO J&K to ensure that the record reached the court before the next date. The court directed Sher Ali, who was stated by the instructing counsel to have been elected as sarpanch, not to operate the funds of the 28-panchayat halqa, Kumate, till the next date of hearing. |
