| HC grants Mukhtar-ul-Aziz anticipatory bail, puts restrictions | | | Early Times Report Jammu, Feb 29: High Court has granted anticipatory bail to ex-Joint Director Handloom Mukhtar-ul-Aziz who has been facing allegations of duping the state exchequer of Rs. 1 crore. Although. Police never tried to arrest the accused officer but as a pre-emptive measure, Aziz approached the High Court for a preventative security. The anticipatory bail was granted by the court of Justice Mohammed Yaqoob Mir after hearing the counsel of the accused and the additional advocate general of the state. Court ordered that if arrested in connection with case FIR no. 25/2011, Aziz should be released on furnishing bail to the tune of Rs. 30, 000 and personal bond to the satisfaction of the Investigation Officer (IO) concerned. Court has directed Aziz not to leave limits of state of Jammu and Kashmir without prior permission of this court. It has asked him to remain available to the investigating agency as and when required. Aziz has also been directed not to attempt thwarting process of investigation directly or indirectly. Interim relief means the police can not take into custody the official till the end of this month. Earlier the Anti-Corruption Court Srinagar had turned down the bail application of Mukhtar on the ground that lack of restrictions on the accused will have a bearing on the investigations. A corruption case under FIR No 25/211 was registered against Mukhtar at the police station Vigilance Organization Kashmir on December 16, 2011. Preliminary investigation conducted by SVO say that the official has been brazenly involved in corruption, criminal conspiracy, cheating and forgery. Sources said that despite swindling Rs. 1 crore from government coffers, SVO allegedly shielded official accused of corruption and criminal conspiracy. Sources asserted that SVO never arrested Mukhtar and virtually gave him free hand to destroy the evidence, said the sources. It has been alleged that Mukhtar-ul-Aziz, as Additional Deputy Commissioner (Collector land acquisition) Srinagar had allegedly drawn Rs. 1 crore from state exchequer as compensation against non-existent properties. A case under sections 120-B, 420,467,468 and 471 of RPC was registered against him. According to the SVO's initial investigations, the accused, Mukhtar-ul-Aziz son of Abdul Aziz of Kathidarwaza Srinagar in the capacity of ADC Srinagar connived with T.K.Sadhu (Executive engineer) and committed a fraud of Rs. 1 crore. The duo disbursed a compensation of rupees one crore in favour of certain names which never were entitled to. Non-entitled beneficiaries included Bashir Ahmed Mir son of Ghulam Qadir Mir of Badubagh Khanyar, Srinagar, Ruksana daughter of Gh Ahmed Khan, Rubiya Bashir daughter of Bashir Ahmad Mir, Hayat Ahmad Wani (and his wife Sabreena) son of Ghulam Hassan Wani, Haseena Bhat wife of Farooq Ahmad Bhat, Showkat Gowhar son of Gh Mohd Bhat, Ashiq Iqbal son of Bashir Ahmad and Sheikh Manzoor Ahmad. |
