| Bail denied to SI for opening fire over land feud | | | EARLY TIMES REPORT
Jammu, Mar 2: Forest Magistrate Jammu has rejected the bail application of Vijay Kumar Sub-Inspector Police against whom a case u/s 307/380 RPC r/w section 3/25 Arms Act was register with the Satwari Police Station for firing from his service revolver allegedly intention to kill him in a land dispute. While rejecting the bail application of Sub Inspector, Forest Magistrate Jammu Adnan Sayed observed that offences mentioned in the FIR are non-bailable offences, besides that accused person neither arrested and nor have surrender before this Court, as such this application is not maintainable as this Court had no jurisdiction to grant bail in pre-arrest or when they are neither in judicial nor in police custody.
The investigation in this case is still going on and if granted bail at this stage, there is possibility that accused can also temper with the prosecution witnesses as such this application is dismissed.
Earlier Senior Prosecuting Officer Sanjay Kohli opposed the bail application on the ground that offence u/s 307/380/34 RPC r/w section 3/30 Arms Act which were heinous in nature and offence u/s 307 RPC is non-bail able. (JNF) |
