High court stays SAC's proceedings against CM | | | Early Times Report SRINAGAR, Mar 2: State High Court in Srinagar today stayed the state accountability commission's proceedings against chief minister Omar Abdullah and eights others in the case of appointment of two of hisadvisors and others as chairmen and vice-chairmen of various autonomous bodies. Chairman, Justice (retd) YP Nargotra, and Member, Justice (retd) Hakeem Imtiyaz Hussain of state accountability commission had on February 17, 2012 issued notice to the chief minister Omar Abdullah and eight others to be present or through some agent before the commission on March 5, 2012 to explain as to how he had made the appointments of political beings at various posts. Rejecting the direction of the commission , the state government had approached the state high court granted stay on the entire proceedings of the commission . The state government argued that chief minister can make the administrative orders and accountability commission has no jurisdiction to challenge the administrative orders of the chief minister. The 2-member panel of the accountability commission had said that the appointment of the politicians appears to be political favouritism and nothing else. The appointment of these politicians to these posts requires regular enquiry under section 13 of the J-K accountability commission. "The withdrawal of pay/salary to them without any authority of law amounts to misappropriation of the government funds," the commission had observed. The commission sought to know the rules and regulations governing appointment of such government functionaries besides procedure and criteria, if any, adopted for conferment of status of Minister/MoS on the politicians who are not otherwise members of the Council of Ministers after one Wali Mohammad rather filed complaint against chairperson social welfare board Khem Lata Wakhloo last year. |
