DB reduces fee for RTI | | | Early Times Report
Jammu, Mar 3: A division bench of high court today reduced the fee for seeking information under RTI from different government departments. The court directive came in a PIL filed by B R Manhas, who challenged the fee prescribed by the state government under rules 4, 5 and 6 of J&K Right to Information Rules 2010, saying that it was unreasonable, irrational and against the spirit of Right to Information Act. The division bench of Justice J P Singh and Justice Mohammad Yaqoob Mir observed that the respondents had not filed their response to the petitioner's challenge to arbitrary fixation of Rs 50 as fee in terms of Rule 4, Rs 10, in tems of Rule 5 (1-a), Rs 75 per diskette or floppy and Rs 100 per compact disk in terms of Rule 6 (a) Right to Information Rules 2010. In their judgement, the judges stayed the fee prescribed under Rules 4, 5 (a) and 6 (a) of J&K RTI Rules 2010. The division bench provided that fee payable under rule 4 shall be Rs 10, under Rule 5 (a) Rs 2 for each page on A-4 or A-3 size paper and Rs 10 for each page in legal size paper created or copied and under Rule 6, Rs 40 per diskette or floppy and Rs 50 for CD and ordered that this order shall remain in force till the next date of hearing. |
