Geelani, Mirwaiz seeking to achieve the unachievable | Tripartite Talks On Kashmir | | Early Times Report jammu, March 5: Hurriyat leaders Syed Ali Shah Geelani and Mirwaiz Umar Farooq advocate tripartite talks between India, Pakistan and Kashmiris. In other words, they say that the "Kashmir dispute" must be resolved in a manner that satisfies all the three parties. It is a highly flawed formulation. Jammu and Kashmir is a settled issue and just can't be reopened. It was settled way back in October 1947. At the same time, however, there still exists a problem between India and Pakistan and it relates to the political future of the areas which have been under the illegal occupation of Pakistan since 1947. These areas are called Pakistan-occupied Jammu and Kashmir (POJK) and Gilgit-Baltistan, all parts of the princely State of Jammu and Kashmir. It is this issue that needs a bilateral resolution and that, too, in accordance with the February 1994 Parliamentary Resolution. This unanimous resolution, which was adopted during the time of PV Narasimha Rao, mandated the Government of India to reintegrate the occupied areas into the Indian Jammu and Kashmir. "Pakistan must vacate the areas of the Indian State of Jammu and Kashmir, which they have occupied through aggression," the resolution said. The resolution also said: "The State of Jammu and Kashmir has been, is and shall be an integral part of India and any attempts to separate it from the rest of the country will be resisted by all necessary means. India has the will and capacity to firmly counter all designs against the unity, sovereignty and territorial integrity. All attempts to interfere in the internal affairs of India will be met resolutely". As for the Kashmiris (read Kashmiri Muslim leadership), they have no locus standi in the matter. It was for the Maharaja of the state who was to take a final decision on the political future of his state taking into account the relevant laws on the subject and he took his decision way back on October 26, 1947, when he acceded to India. To reopen the issue of the state's accession to India would be to reopen the whole issue of the country's partition in August 1947 or the emergence of Pakistan as an independent sovereign state. Jammu and Kashmir State acceded to India under the same Act under which Pakistan came into being. The case in point is the Indian Independence Act of 1947. Geelani and Mirwaiz, who actually represent Pakistan and Pakistani interests in India and masquerade as freedom fighters, not only want tripartite discussion on the Kashmir issue, but they also want the Government of India to allow the Kashmiris to exercise their right to self-determination. They say the UN resolutions on Jammu and Kashmir do provide for right to self-determination. It's true that the UN resolutions do suggest that a plebiscite be organised in the state to ascertain the views of the people of the state on their political future. But what Geelani and Mirwaiz conveniently forget is the condition under which plebiscite is to be held in the state. The UN resolution says that Pakistan must first vacate the aggression, Indian forces must reoccupy POJK and Gilgit-Baltistan and restore law and order there before a plebiscite could be organised in Jammu and Kashmir as it existed on August 15, 1947, when India became free. Neither Pakistan has vacated the aggression nor India has reoccupied the occupied areas and, hence, the question of holding a plebiscite in the state doesn't arise. Besides, Pakistan in the meantime not only handed over approximately 5000 sq miles of area of the state to China but also illegally merged Gilgit-Baltistan region with Pakistan. In other words, Pakistan has violated the UN resolutions. It would be only desirable to point out that the UN resolution suggested a plebiscite in the entire state and not a region-wise or district-wise plebiscite. But Geelani and Mirwaiz would not look all these facts in the face because their whole movement is based on falsehood and deceit. It is a different story that New Delhi after the death of Narasimha Rao did not even once called the Pakistani bluff or the Kashmiri Muslim leadership's bluff. On the contrary, those at the helm in New Delhi have behaved meekly, thus emboldening Islamabad and its Kashmiri agents to create more and more trouble for India. |
