HC directive to div com, Samba DC on shifting of oil depots from rly stn area

JAMMU, Mar 6: High court division bench of chief justice F M Ibrahim Kalifulla and Justice Virender Singh today issued a directive to divisional commissioner, Jammu, and deputy commissioner (DC), Samba, on the shifting of petroleum depots from the railway station area here. The court directive came in a PIL filed by Citizen's Forum as regards the modernisation of Jammu railway station to meet the needs of the people.Even as the number of tourists and pilgrims had been increasing here with the passage of every day, there was no proper infrastructure provided by the authorities concerned. The PIL said it was the duty of railways authorities to install escalators and provide modern facilities, including toilets, to the passengers. "The authorities are also under obligation to provide better bogies to passengers who come and leave Jammu railway station," it added.It was also submitted that the railways was under obligation to beautify the station and its surroundings, besides making arrangements for passengers to sit outside.After hearing the counsels of two sides, the division bench directed the divisional commissioner and DC, Samba, to report to the court if there was availability of any other state land to extent of not less than 120 acres to ensure the smooth shifting of the oil depots from the present premises. The judges observed that as per the February 24, 2012, order, Atul Goel, senior manager of Hindustan Petroleum Corporation and Jagvinder Singh, manager of Bharat Petroleum Corporation were present. They had adopted the status report filed on behalf of Indian Petroleum Corporation which said the acquisition of land for shifting of the depots was being carried out on behalf of Indian Oil Corporation as well as the other two corporations. In the status report of IOC, it was stated that 120 acres of land had been identified and that it had made a formal request to DC, Samba, for making it available to it.It was also stated that out of 120 acres of land, a small portion was state land, while the major portion comprised of private land for which the process of acquisition had to be initiated. A requisition was also stated to have been made on behalf of IOC. It was, however, stated that apart from acquisition of land, steps had also been taken to provide an approach land and create other infrastructure facilities.Upon this, the division bench observed that it had now become necessary to ascertain from the divisional commissioner, Jammu, and DC, Samba, as to the feasibility of the acquisition of land at Bara and time limit that would be required for the purpose.
