After 15-yr-long trial, defence employee awarded imprisonment | | | Early Times Report JAMMU, Mar 9: Special judge anti-corruption, CBI court, B L Bhat, after 15 years of investigation and trial, today awarded there years imprisonment and a fine of Rs 1 lakh to a defence storekeeper. Roop Singh, son of Girdhari Lal of Chatwal in Pathankot, was storekeeper-II, GE 574, engineering park, Pathankot, when he was charged with misappropriation of scrap worth Rs 96,500. According to the CBI case, a sources information was received on July 31, 1997, at CBI office, Jammu, wherein it was alleged that Roop Singh and other officials, while working in the office of GE 574, engineering park and G E Kaluchak, had in 1991-93 misappropriated 19,300 kg scrap worth Rs 96,500. A case was then registered under sections 120-B and 409 of RPC against the accused and, after completion of probe, the challan was presented in the court. Bhat, after hearing the counsels of the two sides, said it could be held with the highest degree of satisfaction that the prosecution had led cogent, convincing and reliable evidence to rebut the presumption of innocence available to accused. The innumerable instances detailed herein sufficiently hint at a racket being run by accused in collaboration of some characters, identified as well as invisible. On account of death of co-accused A P Tiwari, it would be both impermissible as well as inappropriate to pronounce upon his guilt or innocence. However, reference to material indicating existence or otherwise of a criminal conspiracy interse the accused was inevitable. Be that as it may, this case brings to fore procedural lacunas and lapses in dealing with the disposal of scrap material by defence establishments which are expected to adopt flawless procedure and execute the same meticulously. It is unfortunate that corruption has spread its tentacles to the defence establishments hitherto known for being opaque and immune to the menace of bribery. It is also unfortunate that the accused has indulged in misappropriation of government stores umpteen times, solely or in collaboration with others, and the corrupt practices have been going on unabated for quite some time. This case must have sounded a clarion call for the defence establishments to gear up and plug the loopholes. The sooner the better. With these observations, the court awarded the accused three years of imprisonment and a fine of Rs 1 lakh with the direction that the amount of fine be deposited within 30 days failing which it should be relied from the estate of the accused. |
