HC directs authorities not to deport PoK resident | | | Early Times Report JAMMU, Mar 10: High court judge, Justice Mansoor Ahmad Mir today directed respondents not to deport Ghulam Rasool Rather to PoK, from where he had come to meet his relatives at Thanamandi in Rajouri, till the next date of hearing. The respondents were directed to reply before April 9, 2012. When he came to Thana mandi, he was putting up at Mohalla Habib Gunj, Beroon Sheranwala Gate in Lahore, Pakistan. In his petition, Rather claimed to be the permanent resident of J&K and citizen of India. He submitted that in his childhood, he along with his father was forcibly lifted from his native village Behrote in Thana mandi, Rajouri, by militants who had come from across the border and whisked them away to PoK. He claimed that while he was in PoK/Pakistan, he neither owned any moveable or immovable property nor he applied for the entitlement of such rights. He said he worked as labourer in PoK and later visited Lahore where he started his business at Habib Gunj. That after the governments on both sides decided to allow the divided families to meet their family members, relatives and friends, he applied for visa/permit and was given permission to visit Behrote. Accordingly he was issued the residential permit and allowed to stay in J&K. However, during his transit to this part of the state, he fell ill and lost his passport along with the visa and residential permit. In this connection, he lodged a report with Thanamandi police station and also applied for the issuance of duplicate copies of his documents. While the respondents were yet to take any decision in this regard, local police were asking him to return to PoK. The court, however, directed the respondents not to deport the petitioner till next date of hearing. |
