Petition filed against trial court order "favouring" minister Manohar Lal | | | Early Times Report JAMMU, Mar 12: A petition has been filed in the high court, challenging a trial court order of March 12, 2005, whereby proceedings were drawn against minister of state Manohar Lal. The order was passed in a criminal case titled state v/s Labhu Ram. The case was registered at Billawar police station under section 409 of RPC. Justice Mansoor Ahmed Mir of high court, after hearing the counsels of two sides, observed that the FIR NO 46/2000 was lodged against Labhu Ram at Billawar police station under section 409 of RPC but the petitioner was acquitted vide judgment and order of March 12, 2005, and Manohar Lal was given notice to appear in court. The judge observed that the trial court, after examining the show-cause notice held that the reasons put forth by Manohar Lal were not convincing but, in an arbitrary and per-functionary manner, dropped the proceedings against him, which on the face of it was abuse of the process of law. The trial court had virtually passed an illegal order against the basic principle of law and it was a case of travesty of justice and set aside the order and remand the case back to the trial court with a direction to pass fresh orders after hearing Labhu Ram and Manahar Lal within two months and report compliance. |
