Fundamental rights of Kashmiris ignored, says Tarigami
What About Jammu?

Jammu, Mar 14: On March 10 & 11, CPI-M leader and MLA Kulgam, MY Tarigami, demanded "a new Constitutional settlement…to resolve Kashmir issue" and said that the new constitutional settlement should "focus on granting substantial self-rule/autonomy and granting Constitutional guarantees against its misuse in future". He put forth these suggestions while speaking in a meet organised by former interlocutor Radha Kumar in New Delhi. The theme of the meet was "Achieving Peace in Jammu and Kashmir: Options Today".
On March 12, Tarigami said that "Kashmir problem essentially pertains to human dignity" and opined that "fundamental rights of Kashmiris are being ignored". "We the people of Kashmir have grievances and the Government is insensitive and committed to only its stated positions on related issues," he also said. He made these observations while addressing a convention on "Democratic Rights of Kashmiri Youths". The convention was organised in New Delhi by the Centre for Policy Analysis (CPA) in which many Kashmiri students, who are studying in Delhi and elsewhere participated. The CPA is being run by pro-separatist journalist Seema Mustafa.
The statements and suggestions of Tarigami clearly suggest three things. One, he, like other Kashmiri leaders, is not happy with the existing politico-constitutional arrangement between Jammu and Kashmir and New Delhi. He suggested that Jammu and Kashmir be granted substantial self-rule/autonomy. In other words, he vouched for a system that is outside the constitutional organisation of India (read semi-independence or a step short of independence). Two, Kashmir is a human problem. By human problem he obviously meant that New Delhi's presence in Kashmir is against the will of the "people of Kashmir" and that New Delhi has been violating the human rights of the people of Kashmir. Three, the "people of Kashmir do not enjoy "fundamental rights".
Ignore the first two suggestions which every Kashmiri makes every now and then in and outside the state to make his/her stand public that he/she is a Muslim and, hence, a member of distinct nation that needs to be treated in the fashion the Muslim League wanted the Muslims in the pre-1947 period to be treated. Let's focus on the third suggestion that he reportedly made on March 12 while addressing the convention on "Democratic Rights of Kashmiri Youths" -- "Fundamental rights of Kashmiris are being ignored".
It needs to underlined that Jammu and Kashmir acceded to India in October 1947. The immediate fall-out of the state's accession was the transfer of political power from Jammu to Kashmir. Ever since then, it is Kashmir and the people of Kashmir (read their leaders) have been ruling the state. Kashmir and the people of Kashmir have more representation in the state legislature and Indian Parliament. The Chief Minister of the state has all along been from Kashmir. Kashmir and the people of Kashmir dominate the civil secretariat and all the politico-administrative, educational and economic institutions. Kashmir and the people of Kashmir swamp all the institutions, government and semi-government, located in Kashmir. Kashmir and the people of Kashmir play all the shots and dictate terms. Kashmir and the people of Kashmir also control almost everything in Jammu province and the trans-Himalayan Ladakh. Kashmir always gets a preferential treatment from New Delhi.
The truth, in short, is that Kashmir is the most prosperous and pampered region in the entire country and the people of Kashmir a highly privileged community in the country. It is the people of Jammu province, besides over 1.5 million refugees this province houses, who have been leading a miserable life and whose human rights are being violated ruthlessly by the state apparatus. It is the people of this province who have no say whatsoever in the governance of the state, notwithstanding the fact that there are a number of Jammu-based ministers in the Council of Ministers. It is Jammu province which houses many oppressed and persecuted communities, including the refugees from West Pakistan who do not enjoy even the right to own property, right to vote, right to service, right to bank loan and right to higher and technical education.
Which fundamental rights Tarigami talked about in the convention? He needs to explain.
