No consensus in cabinet, issue referred to law ministry | Private practice of doctors | | J&K to have own nursing act
Jammu Mar 16: Following no consensus over the crucial issue of imposing ban on private practice of doctors, the NC led coalition government today referred the matter to the law ministry and asked it to examine the legal implementation of the ruling given by division bench of J&K High Court.
The law department would look into the matter and determine next legal course to be adopted by the government, in terms of following or not implementing the High Court ruling.
The matter came up of discussion during the Cabinet meeting held under the chairmanship of Chief Minister Omar Abdullah but no consensus could be arrived at due to diverse views of members. Even as the matter was discussed threadbare during the meeting, sources said all the cabinet members were not of unanimous view that ban the imposed on the practice of doctors who are in government jobs. It was in the wake of lack of consensus that matter has been referred to law ministry for determining next legal course for the government.
Pertinent to mention here is that imposing ban on private practice of thousands of doctors shall have huge financial implication on the government which is already faced with financial crises. Since, it would become mandatory for the government to compensate doctors with substation remunerative perks, it would mean huge financial burden on the government.
In yet another significant decision in the health department the cabinet has approved the decision that would pave way for having own Nursing Act in the state. The Act would determine and regulate the functioning of Nurses under a council or governing body, which has hitherto been regulated under the Punjab and Haryana Nursing Act.
The Cabinet also took one more significant decision with regard to repeal of existing Rental Control Act. The amendment of the existing act would facilitate to protecting and ensuring balance with regard to rights of both landlord as well as tenants/lessees in the commercial and private establishment.
