| Once we get power, we enjoy the same and we forget the purpose, object and motive fixed by us before getting it. Political power is not for service of people, now a days. Maharaja Hari Singh was compelled to relinquish power in favour of Sehikh Mohd. Abdullah after, he signed the instrument of accession. It was peak time of migration from Pok, West Pakistan towards this part of the country. State of Jammu and Kashmir was not serious to do justice with refugees and eye-wash efforts were made. Followed by a proposal of state government in 1999-2000 for release of Rs. 112 crore by Centre government. A package of 47 crores was sanctioned in August 2000. Interesting part is that process of verification with more formalities and complication started in 2000 again and 4988 claims were received and 3826 were verified and in 2004 again 1950 claim were received. In fact a separate department was required for receiving claims and counting heads but same was not done till date. The payment of ex-gratia relief was calculated upto 25,000 per family with other condition and it was not possible for the sufferer to satisfy the conditions. No purposal was moved for settlement of youth and compensation as per loss suffered, while migrating from POK. Solution lies in permanent settlement and a policy to this extent is required to be framed instead of temporary measure. EP Property be allotted with right of ownership. Verification process be simplified. Compensation be given, students be accommodated in Engineering and Medical Colleges by allocation of separate quota. Reservation be provided in professional colleges of the country, 8 to 10 seats in assembly be allotted to them by amending constitution of J&K as 24 seats are reserved in PoK but actual control is not with Indian side. Procedure of PRC be simplified by amendment in the constitution of J&K. Autonomous PoK refugee Development Board be constituted with financial power, refugee leaders should be involved in dialogue process with respect to problems of PoK and till final settlement. Benefit of migrants from Kashmir like monthly relief, ration, reservation in professional college be extended. Separate nomination for MLC must be done by amendment in the constitution. Lone facility for business and other schemes be extended. West Pakistan Refugees of 1947 are worst sufferer and total 5,764 families were registered consisting of 47,215 in number at initial stage without conducting proper survey. They got settle in Jammu, Kathua and Rajouri district of Jammu region. No formal land was allotted but as for govt. record 46,466 kanal of state land were allowed to be retained under cabinet order No. 578-C of 1954. Civil and Political rights were not granted. They are not allowed PRC, they can not purchase land, they can vote for parliament constancy but for legislative assembly they are still demanding their right to vote and representation total number is more than a 7 lakh. They are considered citizen of India and they are not other citizen of J&K state. This demand was not met causes great hardship and violation of human rights since 1947. In March 2012 refugee action committee marched towards Jantar-Mantar at Delhi and are continuing their protest at present to get justice. They should be provided separate set up to meet out basic amenities of life and funds should be allocated and job oriented policy be framed being worst sufferer. SC/ST/OBC and benefits of social castes be extended to them special package of centrally sponsored schemes be made applicable and state should formulate a separate policy with human approach, state is inclined to settle few militants residing across the border, why these person are ignored? Custodian property be allocated to them and they should not be refrain from casing repair and construction, rather ownership rights be extended over the custodian property. Domicile certificate should be issued by simplifying the policy. Delegation submitted memo of demands on 21-09-2010 in all party meeting, formal order for implementation of package for admission formula Dated 27 May 2009 was insisted. On 17 May 2007 memorandum was also submitted to Prime Minister of India who in rebuttal said that he is also a refugee. But lip sympathy will not yield any result. West Pakistan refugee action committee carried out protest and dharna for full one year in 2005 at Delhi and on assurance of Home Minister same was withdrawn. The worst sufferer require sympathetic consideration. Rather government is duty bound to settle them properly on this side of Indian territory. Chhamb Displaced Persons are not property adjusted 1965 was the year of Indo-Pak war and many people were forced by circumstances to migrate from Chhamb Niabat and some settled in 6-7 villages of Jammu district and were normally termed as camp DPs. They could not go back even war was over. 15,000 families were uprotted and as per official so called settlement report all are settled in 6-7 villages land stand allotted as per government records.For Chhamb displaced persons 1971 non camp DPs government formulated a policy to settle these displaced by granting ex-gratia relief of Rs. 25,000 per family and total 1965 claims were received and 1687 were verified few were sent for re-verification and 82 were rejected and claim approved so for were 502 and Rs. 3.075 crore was released and Govt. of India has further released an amount of Rs. 83 lac for implementation of relief package for non-camp DPs of 1971. Camp DPS of 1971, 699 families were registered residing in Jammu and Kathua 3 crore were released for them many families were left which were not registered. Even guidelines issued by Hon'ble Supreme Court of India regarding formulating policy for settlement of refugee dispute/problems and doing justice on economic, social and cultural side in Bacchan Lal Kalgotra case decided in 1987 were not followed. It reflects that state as well as centre government is dealing the issue of refugees without any policy and there is no will to do justice. In 2005 protest march was launched at Jantar Mantar by West Pakistan Refugee Action Committee and same is repeated in 2012 but political will is must if government really wants justice be delivered although delayed.
