Court frames charges against mill owner, patwari in 1.30 cr bank fraud

JAMMU, Mar 22: Special judge anti-corruption (CBI cases) B L Bhat today framed charges under section 120-B read with sections 467, 468 and 471 of RPC, 5(2) 5(1) (d) of prevention of corruption act 2006 and section 161 of RPC against a mill owner and a patwari for allegedly committing a bank fraud of Rs 1.30 cr. The charges were framed against Gharu Ram, proprietor of M/s Jai Lakshmi Rice Mill, Kothe Chohala in R S Pura, and Vinod Kumar, who has served as patwari of Kothe Chohala.According to the case, Gharu Ram, son of Sain Dass Kothe Chohala approached PNB's canal road branch in 2007 for securing credit facility and term loan of Rs 30 lakh and working capital facility of Rs 60 lakh under the small- medium enterprises scheme for setting up a rice mill at Kothe Chohala. It was alleged that the term loan and capital loan of Rs 90 lakh were sanctioned by S K Jain, PNB chief manager of canal road branch on the recommendation of concerned officer of the bank in favour of M/s Jai Lakshmi Rice Mill. On October 2008, Gharu Ram again approached the bank for the enhancement of cash credit limit from Rs 60 lakh to 1.25 cr for the promotion of business against hypothecation of stock and his land measuring 11 kanal 16 Marlas at Kothe Chohala. It was alleged that CC limit was enhanced from Rs 60 lakh to one cr in 2009 on the recommendation of J K Sharma, who was then senior manager in bank's canal road branch. It was alleged that Gharu Ram submitted fake and forged revenue documents while obtaining credit facilities to the tune of Rs 1.30 cr from the said bank. As per revenue record, the land mortgaged to the bank did not exist in the name of Gharu but belonged to other villagers. The credit facilities were used by the mill owner for his own ends and no repayment was made to the bank as a result of which the loan account turned NPA on September 30, 2010. After completion of investigation, the challan was today presented in the court.
