| HC stayed the proceedings initiated by SAC on anonymous complaint against Custodian General | | | Jammu, January 23, 2007 Vacation Judge of J&K High Court Jammu wing Justice JP Singh today in three writ petitions filed by Mr. Azad Ahmed Lone the then Custodian General of J&K presently Director Employment Kashmir against whom the J&K State Accountability Commission initiated proceedings on a anonymous complaint, stayed the proceedings till further orders. In the three writ petitions in which Advocate DS Chouhan appeared has submitted that on two anonymous complainants the SAC started proceedings in which comments of the Custodian General were invited. The custodian General on February 7, 2006 furnished its comments denying the allegations leveled in said anonymous complaints. The counsel for the petitioner further submitted that the entire record with regard to the allegations leveled in those anonymous complaints has been seized by the State Vigilance Organization and the House Committee headed by Mr. Bhim Singh MLC was also holding enquiry with regard to same allegations. In the petition it has been prayed for quashing Regulation 9 of J&K Accountability Commission Regulation 2005 and also seeking quashment of order dated November 30, 2006 in anonymous complaint and also seeking quashment of proceedings pending before the SAC. Justice JP Singh after hearing Adv DS Chouhan appearing in three writ petitions issued notice to State of J&K and J&K Accountability Commission through its Registrar and in the meanwhile proceedings before J&K State Accountability Commission qua the petitioner shall remain stayed till further orders.
