| Court awarded one year RI and fine Rs 5000/- to a driver for causing death of a pedestrian by rash and negligent driving | | | Jammu, Jan 23, Special Municipal Magistrate Jammu Mr. Sanjay Parihar today awarded one year imprisonment and fine Rs 5000/- to Sandeep Sahni a driver of Maruti Van who by rash and negligent driving has caused accident and seriously injured pedestrian Mrs. Shanti Devi on August 4, 2001 and the injured who was admitted in the hospital succumbed to her injuries on August 6, 2001. While awarding sentence Mr. Sanjay Parihar Special Municipal Magistrate Jammu after hearing Sr. Prosecuting Officer Mr. Jawaid Ahmed Khawaja appearing for the state said that the accused Van Driver was found driving his Maruti van firstly at high speed and secondly with head lights of the vehicle off, which a prudent and reasonable man would not have done, his conduct thus comes within the ambit of culpable negligence that resulted in the causing of occurrence. The charge of causing death by rash and negligent driving against accused Sandeep Sahni established as such he is held guilty of offence u/s 304-A RPC. The accused convicted and sentenced to undergo rigorous imprisonment of one year and fine Rs 5000/-. The fine if realized shall be disbursed to the heirs of the deceased as compensation.
