Court rejects pre-arrest bail of mediator in MBBS/BDS examination scam | | | early times report JAMMU, Mar 29: Principal sessions judge Jang Bhadur Singh Jamwal today rejected pre-arrest bail of Abdul Majid Rather, son of Abdul Rahim Rather of Chhbanday, Bandipora, who was alleged to be the mediator between candidates and impersonators in the MBBS/BDS entrance examination scam. The daughter of an ex-minister and the son of a NC leader were alleged to be involved in the scam. The accused had impersonated in the 2010 common entrance test conducted by Association of Private Unaided Medical and Dental Colleges of J&K/ ASCOMS, Sidhra, Jammu on behalf of actual candidates. The accused were caught impersonating during examination at Jammu University on August 21, 2010. A case in this regard was then registered at Gandhi Nagar police station on the written complaint of director admissions. It was noticed by the staff on duty that Lalit Kumar, Sateyandra Singh, Om Parkash, Mumeen, Sheetal Gupta, Shruti Gaur and Jabar Singh were impersonating for Takshya (Roll No 100408), Mohammad Sadiq (Roll No 100402), Rohit (Roll No 100417), Lobash Bharat (Roll No 100048), Arshi Kiran (Roll No 100008), Huma Tabasum (Roll No 100024) and Sneh (Roll No 100508). The investigation of the case was taken up by CBI during which the relevant records were seized. The role of the petitioner came to the limelight during examination of other accused/ suspect persons. The petitioner had collected the documents in the shape of marks sheets of 10th and 12th classes, state subjects and photographs of Mohammad Sabiq and Mohammad Aqib Shonda and conspired to arrange the impersonators for them in lieu of money. The petitioner was instrumental in finalizing the deal with the actual candidates and then tying up with other co-conspirators to arrange the impersonators. He handed over the above said documents to Shahnawaz Hussain, accused, who arranged the impersonator for the actual candidates. Dismissing the pre-arrest bail application of the petitioner, the judge observed that aspect of the case was required to be investigated from the petitioner and in case, the pre-arrest bail was granted to him, the entire gang behind impersonating in such examinations would not be unearthed. Such people were working in stealing the faith of the meritorious candidates and creating an impression in the public that no system was working perfectly. This sort of impersonation had to be discouraged heavily. The offence alleged to have been committed and the quantum of punishment provided therein extended up to life imprisonment. The faith of general public had been shattered by these people and the conscious of the court was also shattered. The judge said he was satisfied that the petitioner, at this stage, was not entitled to grant of pre-arrest bail and a custodial interrogation was required. The application was hereby dismissed and the interim bail granted to the petitioner in anticipation of his arrest vide order dated March 20, 2012, was withdrawn. The CBI may proceed ahead if the petitioner was required to be arrested in the case, the judge ordered. |
