In carriage contract controversy, HC directs | FCI not to release payment to 3 contractors | | Early Times Report JAMMU , April 4: In a petition filed by Vikas Transport Company, challenging the FCI decision to allot road transport contracts for various stations to M/s Iqbal Motors Transport Service, M/s Tramboo Trading Company and M/s Durga Enterprises, Justice J P Singh of high court today directed FCI and its functionaries not to release the money that may become payable to the owners of three companies. It was alleged in the petition that the three contractors were ineligible to participate in competition for the allotment of contracts. They did not have requisite experience, certificate of transportation for any of the immediate preceding five years in terms of the clause of tender notice. Justice Singh, after hearing the two sides, observed that the petitioner had justified his eligibility on the basis of documents placed on record. The issue projected by the counsels interpreting clause 1 an 2 differently could be considered for determination only after perusing the respondent's response to the petition and the records of the FCI as to how was the issue of eligibility of three private transporters which was stated to have been raised by the contract allotment committee dealt with by the corporation and issued notice to the respondents and observed that in the meanwhile to protect the public interest and interest of the parties, the FCI and its functionaries were directed not to release the money that may become payable to the transport contractors for the contracts allotted to the respondents. The court directed that the money payable to them shall be deposited by FCI with the Registrar Judicial of high court and this order shall remain enforce till next date of hearing. |
