HC orders authorities to allow college student to take examination | | | Early Times Report JAMMU, Apr 5: High court chief justice (acting) Virender Singh today ordered the authorities concerned to allow B Sc part I student of government degree college (boys), Udhampur, Ajay Sharma to take rest of his exams in case he fulfilled all the requirements necessary for appearing in the examination except the shortage of attendance as pointed out to him at this stage. Because of his involvement in a criminal case under section 307 of RPC, Ajay was placed under suspension from September 19, 2011, to November 29, 2011, when he was allowed to attend the classes. He was allowed to appear for examination of two subjects -- English A and Physics A -- held on March 13, 2012 and March 20, 2012. However, when he was to appear in the third paper of Math, he was informed in advance that he would not be allowed to take the examination. He then moved the court which directed respondents to permit him to appear in the examination provided he was fulfilling all the requirements. Pursuant to the said order, he was allowed to appear in the Math paper held on March 26 last. His counsels then submitted before the court that the college principal had told them that since he had shortage of attendance, the petitioner would not allowed to appear in the next examination of computer application-A which was to be held on April 6, 2012. Justice Singh, after hearing the two sides, observed that keeping in view the fact that the petitioner had earlier been permitted to appear in the examination by the high court, it would not be proper if he was debarred from appearing in rest of the papers and that too on account of shortage of attendance, which was never conveyed to the petitioner. Upon this, the court issued notice to the respondents returnable within two weeks and ordered that in the meanwhile the respondents would permit the petitioner to appear in the remaining papers of B Sc part I provided he fulfilled all the requirements necessary for appearing in the examination except the shortage of attendance as pointed out to him at this stage. |
