Court acquits bank Inspector from corruption charges after 15 yrs of trial | | | Early Times Report JAMMU, Apr 5: Special judge anti-corruption Pawan Dev Kotwal today acquitted Jammu Central Cooperative Bank (JCCB) Inspector Janak Singh Chouhan of corruption charges after 15 years of trial on the ground that the sanction order was not admissible in evidence. On March 19, 1997, a written complaint was filed by a number of complainants of Dhargloon in Mendhar, Poonch, alleging therein that Chouhan had demanded and accepted Rs 1,000 to 2,000 as bribe from them in connection with their loan cases. While some cases were got sanctioned by him, some were not. The complaint was addressed to PDD minister. It was later forwarded to SVO commissioner by MoS PDD through his private secretary. After the completion of investigation, the challan was presented in the court, which were bifurcated on the court direction and four challans were presented against Chouhan. Kotwal, after hearing the two sides, observed that in this case sanction order was not formally proved by examining the sanctioning authority or the chairman of the bank. Therefore, in view of the law laid down by the court, the sanction order was not admissible in evidence. Failure to prove the document had not only caused pre-judice to the accused as he had right to know as to what material was placed before the sanctioning authority but rather in the absence of proof of valid sanction, though, cognizance in the given circumstances was not bad, but, trial was vitiated. With these observations, the judge dismissed the challans as the SVO failed to lead consistent and credit-worthy evidence inspiring confidence of the court to establish demand and acceptance of illegal gratification by the accused. The court acquitted him of all the four challans presented against him. |
