| Any good and healthy policy because of its faulty implementation or wrong application does stumble to get crippled in its objective so much so as to receive a slur to very name to become to be called ailing and unhealthy policy. The very purpose gets defeated altogether to create chaos and bitterness in the society. The net result is that the theme of the policy suffers a lot by being confirmed to the pages of the Rule Books alone in black & white, while the mis-users of the rules and norms defying the laid down procedure (parameters) make the mare go at their sweet will for their desired motives by having the trump card of vested power in their hands just to benefit a section of their favorite group, and yield frustration and bewilderment for the common lot who are without any support. This is really quite unfortunate and a stigma on the part of such authorities of the administration as care least for the rules or the basic policy by adopting their own monopoly and anarchy to create a battery of sufferers for the undue benefit of a few favorite or preferred ones. Now turning towards the Transfer Policy in respect of the employees (Gazetted and non gazetted) of various departments of our State Govt. one finds more or less an identical picture. No doubt, the policy in respect of transfers is full of justification and substance with clear cut rules that the minimum stay of an employee at a station must be two years and the maximum not exceeding three years, except if otherwise required under some unavoidable situation as per the administrative strategy. Commenting on the policy someone was right in totality when he sounded on the public platform that one of the main causes for the far-flung, remote, cut off and difficult interior areas of the State to remain uncared for, under-developed and uneducated has been that most of employees posted in these areas do not go to deliver goods and if at all they go, it is once in a blue moon. Admittedly it is a fact that most of the employees through their channels of political approach or other unfair means manage to get their transfers cancelled to have themselves posted elsewhere at their place of choice. This is a big lacuna and loophole in the administration particularly on the part of the District Level and Province Level officers or HODs vested with the power of issuing transfer orders who succumb to pressure or to other unfair means to throw the rules to winds by issuing unjustified orders just to benefit the influential and harass the other dedicated helpless employees who for want of any type of influence are made as scape-goats by sending them in a far-flung cut-off areas despite their having remained in such area earlier for years together. Despite their severe remonstrance and voice against the injustice they find none to come to their rescue. Their honesty and dedication are made to crumble & roll down from their eyes through copious tears. This is how the irony squeezes away their honesty from them and how the injustice turns their devotion and sincerity into truancy. There are many pathetic instances that employees in various departments who being sincere, devoted and hardworking but without any approach, are often transferred to interior difficult area where they do go , but they are made to be stationed there for a dozen of years as if in exile, and there is none to listen to their woeful plight & protests to get them back out of the station. Some of them even retire from the same place of posting after 13 or 14 years with heaps of despair, frustration and dejection in their lap as the unique gift to them by their Department at the end of the their service. For such employees human rights violation stares them to the face and is all smiles before them. Equally contrary is the other part of the story or the other face of the coin where employees with influence and a strong back manage to revolve or rotate within a radius of 10 kms at the various stations of District Head quarters of their choice particularly in Education and some Departments throughout their service career under the soft Patting hands of their officers invested with the power of issuing the transfer orders-. These officers or HODs must maintain the balance of justice at least under the fear of God, to decide the things on merits, reason and ground reality in real perspective, and be cautious and considerate not to distribute smiles for one lot and sobs for the other. They must maintain a justified equilibrium. There are some doctors who being kiths and kins of high ups and political stalwarts have never tasted a chance of being posted even outside the winter capital, let alone the District Jammu. They have managed their postings in various Hospitals in Jammu city itself or at the most in its nearest vicinity throughout their service period. Same may be the case at Srinagar too for the pet Doctors. So under the given situation it is high time and the need of the hour that the system be streamlined, overhauled and well defined, bold & effective, transparent and meaningful & a uniform and rational policy of transfers be framed with strict and stringent instructions and thrust for true, fair and effective implementation of the norms, rules and regulations to put the faulty set-up on the right track for better results. and outcome, where under employees hailing from Districts of Jammu & Srinagar and other Districts be transferred to serve in the interior, far-flung difficult areas compulsorily like Marwah-Dachhan, Padder, Bhallessa, Pogal, Gool, Poonch, Rajouri, Duddu, Basantgarh, Bani Baso1i etc. for a minimum period of six years in two terms during their service career; of course) with regard to their qualification, speciality etc and the availability of the post with infrastructure and other essentialities where they are posted. Also rotational procedure of transfers be adopted in such a manner that an employee once having served in the interior far-flung area for 5 to 6 years be transferred to Jammu or Srinagar District HQ or any other District HQ as per his request and the employees from the District HQ be sent to interior areas who are duly required to serve there. An employee having served in difficult area be allowed to serve the District HQ or the Teh. HQ outside the difficult area, for at least three tenures and then only be asked to serve the difficult area again, if the need so arises. The HODs and the transferring authorities must maintain an upto date full detail (biodata) of various postings of the subordinate employees under them properly fed into the computers to keep themselves fully equipped and well-informed to the effect to deliver justice in effecting transfers without any disparity. In any case if injustice is done, it must be solved with precision on merits. Even for class-IV employees a defined rotational policy of transfer be framed where under they also be transferred from one Tehsil to another Tehsil of the District in the particular department or from one District to other so that they too don't get stationed at one place. They too must realize that transfer is an essential part of service. The nutshell of the whole issue is that it is only the lot of honest, sincere and dedicated employees or officers who have no means of direct or indirect approach with the high-ups or icons of the administration, who discharge their duties in the interior far-flung difficult areas in true spirit for much more periods then actually required, while the other lot of employees with access to the political or administrative circles never. Cross the boundary line even of their District HQ. If they are posted into the interiors they either get their orders cancelled Changed before going there or manage their return to the place of their choice in a couple of months and this should not be allowed. The Hon'ble Chief Minister, young and dashing, dynamic and considerate, and of course rational, is requested to look into the matter amicably to stre amline the system particularly the genuine implementation of the transfer rules in true spirit to avoid stagnations which prove a boon for one lot and a bane for the other. |
