HC restrains respondents from presenting challan against DSP | | | Early Times Report JAMMU, Apr 14: Justice Mansoor Ahmed Mir of High Court today issued notice to SHO of Reasi police station and senior officers who were that time posted as ASP, Reasi, and SSP, Reasi, returnable within four weeks, while directing that respondents were at liberty to conduct investigation in the case but they would not present final report unless directed by the court. The court directive came in a petition filed by DSP (headquarter, Reasi) Mohammad Aslam against whom an FIR was registered under sections 294, 211, 186 and 509 of RPC at Reasi police station at the behest of senior police officers.According to the petitioner, he was transferred from Kathua to Reasi as DSP headquarter on March 30, 2011. However, before he joined, SSP, Reasi, divested him of his charge and assigned it to ASP, Reasi. Even as he repeatedly requested the SSP to assign the charge to him, he did not do the needful as had old personal grudge against him (petitioner). He submitted in the petition that on December 8, 2011, SSP, Reasi, issued a deployment order for security arrangement in connection with the visit of union minister Farooq Abdullah at sports stadium, Reasi, on December 10. In the said order, the petitioner was asked to ensure the deployment inside and outside the stadium, besides other duties. The DSP, on December 10, after checking the outer deployment, entered the main VIP gate of the stadium for identifying the location for parking ambulance but the ASP did not allow him on the ground that he had not been assigned any duty in the deployment order. The ASP allegedly directed her PSOs, driver, wireless operator and other policemen to throw the petitioner out of the stadium. On this, head constable Charanjeet Singh, SGC Subash Chander and other police personal assaulted him with fists and blows and threw him out. The petitioner got injured and he immediately got his medical examination done at district hospital, Reasi, and thereafter requested the SSP to initiate legal action against the ASP and other culprits but all in vain. Instead the respondents joined hands and registered an alleged false and frivolous FIR under sections 294, 211, 186 and 509 of RPC against the petitioner and arrested him. He alleged that he was given severe thrashing in the police lock-up. He sought quashment of the FIR registered against him at Reasi police station along with the proceedings carried there under in the interest of the justice. |
