Pre-arrest bail denied to accused all involved in making CD against SIT

Jammu, Apr 18: Principal Sessions Judge Jammu today rejected pre-arrest bail of alleged accused Shahzad Feroz Butt claim to be reporter Sahara News Network allegedly impersonating himself as Mohan at the time of preparing the CD against Special Investigating Team (SIT) constituted for investigation cases for land grabbing. Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today rejected pre-arrest bail of alleged accused Shahzad Feroz Butt claim to be reporter Sahara News Network allegedly impersonating himself as Mohan at the time preparing the CD against Special Investigating Team constituted for investigation cases for land grabbing. According to the police case the complainant Vikramjeet Singh along with one Gurvinder Singh purchased a piece of land measuring situated at Chowadi, Jammu from one Mohd Sharief and constructed the plinth and boundary wall. After the purchase of said land mafia active in Jammu under the patronage of accused Ravinder Kumar Gupta @ Gola Shah started interfering into their peaceful possession. The complainant approached the revenue department for demarcation of the afore said land and after demarcation, it was certified that the land belongs to the complainant and one Gurvinder Singh. The aforesaid accused accompanied by some goonda elements came in the said land and threatened him by aiming his revolver that he shall be done away with his life and in this regard they got registered FIR No. 171/2011 with P/S Gangyal. Numbers of cases are pending against the accused Ravinder Kumar Gupta, his associates and other known land grabbers in different police stations.
A Special Investigating Team was constituted who took over the investigation. That the complainant scared by the threats extended by the accused, fell into their trap and agreed in making false statement against the police official with regard in demanding of money on the asking of the accused for which the accused have made a false CD in order to save themselves from the SIT and injurious the reputation of the officers.
The accused persons after making a criminal conspiracy at Jammu with a view to save themselves from the investigation carried out by the SIT reached Delhi on 2.2.2012 and with criminal intentions called the complainant to make a false statement with regard to which they made a false CD. On the basis of this written report and on the direction of court, the police registered the case under FIR No. 42/2012 for the commission of offences U/Ss 341/352/452/504/506/464/469/471/120-B RPC & 3/25 Arms Act and commenced the investigation thereupon. During investigation, the police recorded the statements of various witnesses u/s 161 CrPC and 164-A CrPC. During investigation further, the offences U/Ss 342/327 RPC and 66-A IT Act were added in this case. It has also come in the investigation that the petitioner has impersonated himself as Mohan at the time preparing the CD. The petitioner is absconding and his custody is required for the recovery of laptop, CD, etc.
While rejecting the bail Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal after hearing Adv Ankush Manhas appearing for the petitioner and Public Prosecutor for the state observed that If such types of cases are not dealt with heavy hands, there is every likelihood to have a chaos in the society. The petitioner is not entitled to pre-arrest bail as his custodial interrogation is required to be done because the recoveries are pending. With these observations Court denied bail. JNF
