DB directs SSRB to fill-up 89 posts for disabled persons
PIL seeking implementation of Act 1998

Jammu, Apr 20 : State High Court came to the rescue of the disabled persons in a PIL filed by National Federation of Blind Seeking implementation of Act 1998, Division Bench of J&K High Court comprising Acting Chief Justice, Virender Singh and Justice, Hasnain Massodi directed concerned depts that posts available in different categories of persons with disability (Equal opportunities, Protection of Rights and full participation) Act 1998 shall be worked out and same be referred to Service Selection Board within a period of four weeks. The service selection Board shall complete the entire exercise of filling-up the posts of the handicapped categories expeditiously, preferably within a period of three months. This significant direction has been passed by the Division Bench of State High Court in a Public Interest Litigation filed by National Federation of Blind in which sr. advocate PS Dutta with advocate, Pranav Kohli appeared for the PIL whereas AAG Gagan Basotra appeared for the state, AAG Stated that in the instant application which is signed by under secretary to Govt Social Welfare Dept, it has been specifically stated that after working out the total number of deficient vacancies of the posts of teachers from 2007 onwards, 70 posts of teacher are available in different districts. With the regard to the availability of posts JE (Civil), it is submitted that 18 vacancies have been filled-up from the handicapped categories and 12 posts of Junior Engineer (civil) are deficient which can be filled-up from the categories of VISUALLY HANDICAPPED and LOCOMOTOR disability. According to the AAG the posts of JE (Elect) are concerned, it is stated that 746 posts have been filled-up till date out of which the quote available to handicapped category would be 22.38. It is further submitted that Govt has now identified handicapped by one leg, one arm for getting reservation for the post of JE (Elect) and as such the share of this category works out to be saven posts.In the interest of handicapped categories, Division Bench directed the concerned department to refer the posts to service selection board within a four weeks only and service selection Board shall complete the entire exercise of filling the posts of the above said handicapped categories expeditiously preferably within a period of three months.
Before parting with the order Division Bench comprising Acting Chief Justice Virender Singh and Justice Hasnain Massodi directed the Social Welfare Dept Jammu and Srinagar to get wide publicity to the category of posts following under handicapped categories vide government order December 28, 2011 within one month and directed the respondents that compliance repot shall be placed on record on or before the next date of hearing with an advance copy to sr. advocate PS Dutta appearing for the PIL.
