CB produces challan against Mumbai businessmen | Cheating with Jammu based entrepreneur | | Early Times Report Jammu, Apr 20 : The Crime Branch, Jammu has produced challan in case FIR No.19/2009 u/s 420, 336 RPC against the accused persons namely Vijay Bishnoi Prop. Vijay Metal Distributors 201, 2nd Floor Swami Smart Darshan Building, Mumbai, Pradeep Shah and Darshan Shah Props. of M/s Raj Sales, 3 Latief House, Ground 250, Sant Tuka Ram Road Iron Market, Mumbai- 400009 in the Court of Addl. Munsiff JMIC Samba today. Brief Facts of the case are that on 26.06.2009 a complaint endorsed by Ld. Addl. Munsiff JMIC Samba was received in Crime Branch, Jammu under section 156(3) Cr. PC, wherein it was alleged by the complainant Rakesh Khullar, Manager of M/s Visen Industries Ltd., Phase-I, SIDCO Industrial Complex, Bari Brahmana, Samba that accused persons Vijay Bishnoi Prop. of Vijay Metal Distributors of Mumbai and others who are dealing in the business of distribution of metal products including stainless steel pipes, entered into a contract with the complainant for the supply of 304 and 316 stainless steel pipes of specific standard/grade, the samples of which were approved by the Metallurgical Laboratory Pvt. Ltd. and Elca Labs. through M/s Chempro Inspections. The accused persons instead of supplying stainless steel pipes of 316 and 304 grade delivered stainless steel pipes which turned out to be totally off grade and not of that quality for which the orders were placed with the accused. The material was subjected to test check in the company where the complainant observed cracks in the said pipes. Had the material been used it might have caused explosion endangering the human lives in the company. Accordingly, FIR was lodged and investigation started. From the evidence collected during investigation, it has been found that the accused persons dishonestly induced the complainant to buy the poor quality pipes under the pretext of 304 & 316 Grade Stainless Steel Pipes and thereby caused wrongful loss to him to the tune of Rs 1,00,36,940/- besides endangering the lives of the factory workers of the complainant. The accused persons were found to have committed the above mentioned offences and were challaned in the Court of Law for judicial determination. The next date of hearing on in the case has been fixed on 09.06.2012. |
