10 yrs RI for 5 militants who in 2000 fired on Amarnath pilgrims inside Hari Singh school | | | Early Times Report
JAMMU, Apr 21: Principal sessions judge Jang Bahadur Singh Jamwal today awarded 10 years rigorous imprisonment to Tariq Hussian, Bashir Ahmed, Fazal Muneer, Assadullah and Umar Qazi, all militants who were involved in the incident of firing on Amarnath pilgrims inside Maharaja Hari Singh higher secondary school on Residency Road here on August 1, 2000. The court also directed them to pay a fine of Rs 10,000 and initiated proceedings under section 512 of CrPC against Ulfat Jan, son of Mohammad Abdullah of Faqirpura, Anantnag. On August 1, 2000, a militant entered the Maharaja Hari Singh school on Residency Road and fired at Amarnath pilgrims who had gathered there for registration. He had also thrown handgrenades towards them. The militant was later shot dead by police personnel in a brief exchange of fire. During the course of investigation, all the five accused were later rounded up by police for their involvement in the incident. It was found that the accused, at the instance of Lashkar-e-Taiba (LeT), had taken an oath of the holy Quran in Khan Masjid, Pir Mitha, here to target Amarnath pilgrims. Out of these accused, Tariq had connection with Ulfat Jan alias Jan Mohammad, an LeT militant, and Abid, a Pakistani militant. Bashir and Tariq had kept their temporary residences at Gujjar Nagar and Dongia, Bathindi, respectively. Ulfat Jan was arrested on December 14, 2001 from Green Palace Hotel, Hari Market, and on his search, illegal arms were recovered and seized. This time, he had brought ammunition to attack army transit camp. After the completion of the investigation, a challan was produced against the accused in the court. The judge, after hearing the two sides, observed that though the offence committed by the accused did not invite any lenient view, but seeing the age of the accused, scanning of law and legal provisions contained in Arms Act, the minimum sentence was provided for seven years with a fine. Court is conscious of the fact that the accused had been aiding and providing arms and ammunition to militants, but no such evidence could be collected. But they were found in possession of arms and ammunition. In case, a lenient view is taken, these people would be encouraged to repeat the same kind of offence. Accordingly, the request of counsel for the accused for taking lenient view against the convicts is rejected, the judge ordered and awarded 10 years RI to all the five accused. |
