HC stays selection of 82 photographer constables | | | Early Times Report Jammu, Apr 24 : Justice JP Singh of Jammu & Kashmir High Court Jammu Wing in a significant direction issued to the state respondents regarding the selection of 82 constable in photographic cadre has directed that the select list of the candidates in photographic cadre of Jammu & Kashmir police circulated on April 12, 2012 by the police headquarter at Jammu will not be operated upon by the respondents till next date. The selection of 82 constables in photographic cadre in Police department has been challenged in two writ petitions on the basis that the advertisement notice issued by the police head-quarters inviting applications from for recruitment of constables in photographic cadre of Jammu and Kashmir police rather than making selection on the basis of merits of the candidates obtained in the selection through out the state, the police head-quarters has issued the list of selected candidates on the basis of the merit of candidates in each district. Such a course is challenged by the petitioners as unwarranted and in violation of the advertisement notice. Justice JP Singh after hearing Advocates Sudershan Sharma and AM Malik for the petitioners in two writ petitions whereas AAG Gagan Basotra appearing for the state and observed that AAG Gagan Basotra is not in a position to explain as to how selection was made district wise when in terms of the advertisement notice, applications against the vacancies of constables in photographic cadre of Jammu and Kashmir Police had been invited from the eligible permanent residents of the state, thereby the selection had to be made considering the merit of all the candidates who had participated in the selection and not the basis of the merit of the candidates of each district. There appears prima-facie merit in the petitioners' submissions and Court issued notice to State of Jand K through Commissioner/Secretary Home Department and DGP. The respondents may file their response to the writ petition and also to the CMP within three weeks and list in the July, 2012. Meanwhile court restrained the respondents from operating upon the select list. (JNF) |
