10 years RI to kidnapping, rape accused | 3 years RI to accomplices | | early times report Jammu, Apr 24: Additional Sessions Judge Udhampur MK Sharma today awarded ten years rigorous imprisonment and fine Rs 5000/- to accused Mohd Shafi alias Gudda son of Bagh Ali of Birnoo, 3 years rigorous imprisonment to Feroz Din son of Nawab Din and Gashan son of Saraj Din of Birno Tehsil Ramnagar who helped the main accused for kidnapping the prosecutrix. According to the police case that on October 6, 2005 the accused with criminal intention entered into the house of the complainant/PW-1 Saraj Din at village Rasain, Morha Dhar Gulu -Ramnagar in absence of the complainant and kidnapped his minor daughter and wrongfully confined her in the house of accused Mohd Shafi at village Birnoo Tehsil Ramnagar. The accused Mohd Shafi allegedly committed rape upon prosecutrix. On October 8, 2005 the complainant Siraj Din lodged a written complaint against the accused about the kidnapping and wrongful confinement of her daughter and extortion against the accused at police station Ramnagar, on the basis of which FIR No. 83/2005 for the commission of offences punishable U/Ss 343/363/387/380 RPC was registered against the accused at Police Station Ramnagar. Parveen Akhtar on her recovery by the police stated to have been raped by the accused Mohd Shafi. She was subjected to medical examination. During investigation the allegation of extortion was not proved so the commission of offence u/s 380 RPC was dropped. Additional Sessions Judge Udhampur MK Sharma after recording the statements of the victim and taking into consideration the report of the doctor awarded sentences to the accused. (JNF) |
