Court granted interim bail to Gola Shah

CJM Jammu Mr. Sanjay Dhar granted interim bail to Ravinder Kumar Gupta alias Gola Shah with the direction to appear before the IO.
Ravinder Kumar Gupta alias Gola Shah filed bail application through Advocates Sudershan Sharma and Riyaaz Choudhary in case registered by the police u/s 467/468/471/447-A RPC. According to the police case one Sher Mohd Range Forest Officer lodged a report on January 23, 2007 alleging that accused Ravinder Kumar Gupta and his Associate Anu Gupta has started construction over forest land situated at Village Chattah. It was further alleged that accused have also managed forged documents in this regard. After registering the case police started the investigation. During the investigation it was found that accused Ravinder Kumar Gupta alias Gola Shah and accused Anil Gupta alias Anu along wit their associates have made unauthorized encroachment of forest land and have also prepared some false documents in this behalf.
In the bail order CJM after hearing the counsel for the accused and CPO for the state and also gone through the police report, objections filed by the CPO, the counsel for the accused submitted that from the report of the forest official at the most offence u/s 447-A RPC is made out which is bailable in nature and the police has seized none of the so-called forged documents nor any reference is made in the report in this regard. Court further said that the report does not suggest any recovery is to be made from the accused. The investigation of the case has progressed substantially. Keeping in view of these circumstances as well as arguments of counsel for the accused, Court think the accused is entitled to grant of interim bail at this stage. Accused is accordingly admitted to interim subject to furnish of bail bond with one surety in the amount of Rs 20000/- with an undertaking that the accused shall co-operate with the investigating agency, shall not temper with prosecution evidence. Court further ordered that during the period of interim bail accused shall appear before the IO at 10:00 clock daily. JNF
