Appointment of 36 Physical Education Teachers | HC Upholds appointments | | early times report Jammu, Apr 25: In a petition filed by Shashi Prabha challenging the selection of 36 respondents as Physical Education Teacher, District Cadre Rajouri against the vacancies notified vide notifications Nos 03/2006, 03/2007 & 06/2008, the petitioner's claim to selection contesting by the Board that she was ineligible for selection against the post having crossed the minimum age prescribed. So far as her merit position, she was able to secure only 37.08 points. whereas the last selected candidate had obtained 49.55 points. Dealing with her challenge to the selection of respondent No 43 it is stated that although the respondent's name had figured in the provisional selection list but it was later deleted when she was found lower in merit. Justice JP Singh of Jammu & Kashmir High Court Jammu Wing after hearing both the sides observed that petitioner's plea for selection against the vacancies notified vide advertisement notice 03/2007 & 06/2008 in relaxation of age,is found untenable in view of Govt order No 1500-GAD of 2000 dated December 21, 2000 in terms whereof relaxation in age for selection is permissible only of the candidate was otherwise exceptionally qualified. The petitioner does not falls in the category of otherwise exceptionally qualified nor has she set-up case any case of her exceptional qualification in the petition. The petitioner, therefore, being in eligible for selection against the vacancies notified and having obtained points lower than last selected candidate against vacancies notified vide notification No 03/2006 is therefore not entitled to selection as Physical Education Teacher for which she had competed pursuant to the notification and with these observations Court dismissed the petition.
