92 encroachers face danger of being washed away | Tawi bed becomes hot bed of political greed | | Abodh Sharma Jammu, Apr 26: At least 92 families living on the land encroached in the bed of River Tawi face danger of being washed away, but have not only ignored the warnings and notices of the department of Flood Control, but have sought a stay order from the State High Court after the department issued challans against them. While the number of those who have illegally and dangerously encroached into Tawi's bed is much higher, the department of Flood Control has issued notices only to 92 of them under the Water Act of 2010. "The encroachment started with the advent of a few Gujjar families just some years back, but soon it picked up in the form of a Gujjar Basti on the behest of two Ministers of the coalition Government who eyed potential vote bank in them" alleged a local of Pul Par Basti. "Today the number of such houses which came up right in the bed of Tawi has gone over 500, but Revenue authorities have maintained a criminal silence," he added. "Rather than taking strong action against them to get them evicted, the Government has set up a ration depot and a primary health center for them" he rued. The department of Flood Control, however, issued challans against 92 of them in the Court of the Chief Judicial Magistrate in accordance with the provisions of the Water Act of 2010 that empowers the AEE of the department to initiate such an action against encroachers of river beds. "These encroachers face danger of being washed away as we expect the water levels in Tawi to rise higher than the previous years during this monsoon" said RK Gandotra, Executive Engineer, Flood Control Jammu. "There have not been major floods in Tawi since 1988 when the water level rose to 31 ft. at the monitoring gauge at Tawi bridge, but this time as soil is saturated due to unseasonal rains and snow-fall is still occurring in the higher altitudes, there is every possibility of these inhabitations being washed away" said the Ex. Engineer. He, however, confessed that the department of Flood Control got legal right to move against such encroachers only after the Water Act of 2010. "Now that we are making a barrage on Tawi for controlled flow, it has become imperative to evict these families" the Ex. Engineer added. Sources in the Revenue department divulge that many of these encroachers have applied for regularization of land under Roshni Act, but the Revenue authorities have already reported to the court that the regularization of said land was not possible under Roshni Act. It is a pity that while those who migrated from Doda, Kishtwar and other border districts and settled in temporary inhabitations in Belicharana are not allowed to raise even a tin shed, these encroachers were allowed to raise Pucca houses due to political patronage. |
