Appeal seeking stay on CCI elections dismissed | | | early times report JAMMU, Apr 27 (JNF):- Principal Sessions Judge Jammu Jang Bhadur Singh Jamwal today dismissed the appeal filed by one Rajan Dutta against the order of CJM Jammu passed on April 21, 2012 with the observations that As far as the application for contesting election has to be made on a prescribed form has to be filled up by the contesting candidate along with a proposer by the principal member and seconded by the principal member only. Had it been a differentiated the framers of the constitution in their wisdom must have stated that the proposer should be a principal member and could be seconded by any member. The order drawn by the trial court does not infract the legal provisions contained therein or requires any interference. The Chamber of Commerce and Industry is a body constituted under the constitution framed by them and are out to conduct the election in democratic way as is prevalent in this country and is rightly being introduced and the process for the same has already been started and the election are being conducted next day. In such like circumstances, the elections are stayed then every tom, dick , harry will come to the court and flutter the democratic process well suited to the country is being performed. Accordingly, the order drawn by the trial court is hereby upheld. Parties are directed to cause their appearance before the trial court on May 1, 2012. JNF |
