| Advocate General allows filing of criminal contempt against DySP | | | early times report
JAMMU, Apr 27: In a landmark Order, could be first of its kind in the history of J&K the State's Advocate General M.I. Qadri has passed the Order of Consent granting permission to Rajat Jandial to file a criminal contempt petition in the J&K High Court against M L Kaith, DySP, the then SDPO Gandhi Nagar Jammu. In a 8 pages order M I Qadri Advocate General of the State observed...;" I am of the view that the words "succeeded in managing" (bails) expressed by M L Kaith DySP SDPO South, Gandhi Nagar Jammu "constitute" criminal contempt in terms of clause (i) sub section (e) of Section 2 of the J&K Contempt of Courts Act and accordingly the consent as sought by the applicant is granted for initiation of criminal contempt proceedings before High Court, in this behalf in order to preserve and protect judicial institutions and judicial system from using such words which scandalize or lower the authority of Court by a person of status of Kaith DySP. |
