Removes 4 BJP MLAs for defection

JAMMU, Apr 27: In a significant development, Bharatiya Janata Party (BJP) leader, Professor Chaman Lal Gupta has removed four party MLAs on grounds of defection. The removed MLAs include Jugal Kishore, MLA Nagrota Constituency, Ashok Khajuria, MLA Jammu East Constituency, Sukhnanda Singh, MLA Marh Constituency and Sham Choudhary, MLA Suchetgarh Constituency. All of them are members of BJP legislative Party.
Gupta's letter, a copy of which has been sent to the Speaker, said 11 members of J&K Legislative Assembly formed BJP Legislative Party in J&K Legislative Assembly and elected. Chaman Lal Gupta as Leader of BJP Legislative Party. The decision was communicated to Hon'ble Speaker of J&K Legislative Assembly.
The letter accused the aforementioned MLAs of forming a rebel group and elected Jugal Kishore Sharma as leader of BJP Legislature Party.
However, according to the letter, majority of the MLA's i.e seven members of BJP Legislature Party gave in writing to Hon'ble Speaker of J&K Legislative Assembly that Professor Chaman Lal Gupta alone is the leader of the BJP Legislature Party which fact even has been expressly endorsed by the Hon'ble speaker of the Legislative Assembly of J&K on the floor of the house.
The letter makes a mention of a show cause notice served on the aforementioned MLAs wherein they were told to explain why they should not be removed as MLAs for forming a rebel group and elcting another leader in presence of an existing leader by invoking relevant provisions of the Jammu Kashmir constitution.
The MLAs , however, ignored the above notice leaving Gupta with no alternative but to remove them as MLAs in exparte, the letter conveys.
In the concluding para, Gupta removes and disqualifies the aforementioned MLAs on the grounds of defection in exercise of his powers under paragraph 6(1) of the Constitution of J&K read with 8(b) Rule of Members of the J&K Legislative Assembly (Disqualification on grounds of defection Rules 1987) forthwith.
