2 yrs RI, Rs 10,000 fine to Sr Auditor involved in corruption case

Jammu, Apr 30: Special Judge Anticorruption CBI Cases J&K Jammu today awarded two years imprisonment and fine Rs 10000/- to then Khem Singh Sr. Auditor (LAO) Controller of Defence Accounts (CDA) Satwari Jammu who was caught red-handed by CBI team on March 9, 2007 while accepting bribe from the complainant to pass the bills. Special Judge Anticorruption CBI Cases J&K Jammu BL Bhat after hearing Special PP SK Bhat for CBI whereas Adv KK Sharma for the accused observed that prosecution has succeeded in establishing demand of bribe by accused, initially and at the time of trap and acceptance of the tainted GC notes from complainant as illegal gratification and recovery of tainted money from the accused. "The accused is accordingly convicted of offence under sections 161 RPC and 5(2) r/w 5(1)(d) of Jammu & Kashmir Prevention of Corruption Act, Samvat 2006. Since the accused is not proved to be a previous convict and there are no aggravating factors warranting an exemplary punishment, the adequate sentence commensurate with the level of his guilt would be one year's rigorous imprisonment on each count and a consolidated fine of Rs. 10,000/-. The substantive sentences of imprisonment shall run concurrently. The amount of fine be deposited within thirty days failing which the same shall be realized from the estate of accused, the court observed. According to the CBI Case that accused Khem Singh while working as Sr Auditor in the office of local Audit Office (A) Jammu had demanded sum of Rs 1700/- from one Surinder Sharma of Gandhi Nagar Jammu for already passed bills Rs 34312/- as commission from the above bills which comes to Rs 1700/-. The complainant filed a complaint with the CBI, CBI laid a trap and caught red-handed the accused and recovered the tainted amount of Rs 1700/- and after the completion of the investigation challan was presented in the Court.
