HC directs Commissioner Housing to file fresh status report | llegal allotment of shops, halls at Bahu Plaza | | early times report Jammu, May 1: Sate High Court has directed Commissioner Secretary Housing to file fresh status report in a petition regarding illegal allotment of shops and halls in Bahu Plaza commercial complex. Justice JP Singh of J&K High Court Jammu Wing today in a order having far reaching consequences directed Commi-ssioner/ Secretary Housing & Urban Develop-ment Dept to file a fresh status report with regard the affidavit filed by Commissioner/ Secretary GAD wherein the State Govt on April 12 issued directions to the Commissioner/ Secretary Housing & Urban Develo-pment Department to put the allottees of Halls/Shops to notice, seek their objections and thereafter pass appropriate orders with a view to restore the properties to JDA. Court further issued fresh notice to the Commissioner/ Secretary Housing & Urban Development Department requiring him to file the fresh status report in light of the affidavit filed by General Administration Department Court also granted two weeks time to Sajjad Ahmed Bhat brother of Ex-Chief Minister and presently Union Health Minister to file his objections to the petition justifying his allotment. These people friendly directions were passed in the open court today in a petition filed by Sunil Mahajan challenging the allotment of hall No 209 South Block Bahu Plaza in favour of Sajjad Ahmed Bhat brother of Union Health Minister Ghulam Nabi Azad, on the ground that no procedure was followed while making the allotment and the allotment was made on extraneous considerations. Today when the matter was taken-up Advocate Sheikh Shakeel Ahmed appearing for the petitioner drew the attention of the Court to affidavit filed by Commissioner/secretary GAD on Court's directive dated February 22, 2012 wherein the GAD submitted that it was decided to advise the housing and urban development dept to put the allottees to notice, seek their objections and thereafter pass appropriate orders with a view to restore the properties to JDA which would be inconsonance with the orders of the State High Court. The affidavit further said that vide communication O.M. NO-GAD (L) F-534/2009 dated April 12, 2012, the Housing & urban Development Dept has been advised to proceed further in the matter. (JNF) |
