| Bail denied to SI in attempt to murder case | | | early times reort Jammu, May 2: 3rd Additional Sessions Judge Jammu Sanjay Parihar today rejected the bail application of Vijay Kumar Sub-Inspector Police presented posted Ramnagar in District Udhampur against whom a case u/s 307/380/34 RPC r/w section 3/25 Arms Act was register with the Satwari Police Station for firing on complainant namely Nitin Gupta (Presently Secretary Young Lawyers Association) from his service revolver allegedly intention to kill him in a land dispute. While rejecting the bail application of Sub-Inspector, 3rd Additional Sessions Judge Jammu Sanjay Parihar after hearing Adv SM Choudhary appearing for the petitioner whereas Additional Public Prosecutor GS Charak for the state, Adv Nitin Gupta complainant present in person observed that offence is u/s 307/380 RPC are non-bailable in nature and against society and public at large. If petitioner is granted bail it will definitely cause fear in the complainant and his witnesses as the petitioner is a police officer and after committing heinous offence, has been roaming large with tactical supports ofInvestigating Agency, he was asking for relief of bail by way of surrender would shatter the confidence of society and public at large. Bail sought by petitioner on the ground of parity is not applicable to him because as regards the co-accused who already been bailed out. They did not participated the act in the manner that has been done by the petitioner, So bail on the ground of parity does not apply to the case of the petitioner. Despite case having been register on December 17, 2011, petitioner was neither arrested and the fact he sought bail by way of surrender makes it apprehensible that either he has prevailed over the investigation process or if released on bail, he may use his position to influence prosecution witnesses, hence at this stage no case for grant of bail is made out, as bail application is rejected.
