HC issues notices to govt, concerned deptt, asks response within 4 weeks | PIL on water surcharges | | EARLY TIMES REPORT Jammu, May 2: In a Public Interest litigation filed (PIL) by Sat Pal Rathore, a social activist and secretary, Sanatan Dharam Sabha, Jammu against the arbitrary enhancement of drinking water charges for domestic purposes, the High Court issued notice to the State and others. After hearing sr Advocate, S S Lehar with Deepak Kumar Atri issued notice to the state of Jammu & Kashmir through Commissioner-cum-Secretary to Govt, Public Health Engineering irrigation and Flood Control Department, Jammu to respond to the petition filed by the petitioner within four weeks. Pertinent to mention it has been submitted in the petition that right to life has been recognized as a fundamental right of every citizen. The water is a necessity of life and to ensure that no body dies of thirst is the duty of the state. As a matter of fact, the Respondent/State should provide the water to its citizens free of cost, as there are no wells in the State and almost all the natural resources have been closed/ exhausted or destroyed by one way or the other. The petition stated that state of J&K should not earn money from supply of water and added Jammu and Kashmir State has promulgated an Act known as "The Jammu & Kashmir Water Resources (Regularization and Management) Act, 2010." Under this Act, the State has created a Water Regulatory Authority which can fix the water usage charges. As a matter of fact upto April 1, 2010 the drinking water usage charges were Rs360/-- per annum but all of sudden, for the year 2011, i.e. from April 1st, 2011, the water usage charges have been tremendously enhanced and fixed at Rs.800/-per annum and for the year 2012 it has been fixed at Rs.920/-annum which amounts to arbitrary use of powers and it cannot be justified under any provisions of law.
