HC directs convict to pay Rs 1 lakh compensation to injured | | | early times report Jammu, May 5: In the rarest of the rare cases where the High Court reduced the sentence of the petitioner to the period already under gone and fine Rs 2000 imposed upon the petitioner shall remain intact. The injured Sherbaz was awarded compensation to the tune of Rs 1 lakh to be paid by the petitioner within 15 days for deposit the same before the CJM Rajouri. On its deposit the entire amount before Court of CJM Rajouri and on the deposit the entire amount shall be released to injured against proper receipt and identification after putting him to due notice. This significant judgment was passed by acting Chief Justice Virender Singh after hearing Adv AM Malik for the petitioner that Mohd Azam aged 66 years who was awarded sentence by the Trial Court for two years and fine Rs 2000 which he challenged before the High Court. High Court made it clear that in default of deposit of aforesaid amount of compensation the petitioner would be disentitled to relief granted to him and in that eventuality he shall surrendered before the CJM Rajouri for serving reminder of the sentence.
