Political, legal compulsions forced Omar in linking NCTC to AFSPA | | | Early Times Report
Jammu, May 6: Chief minister Omar Abdullah like some other Chief Ministers' has expressed serious reserveations about NCTC. However, this similarity about reservation ends. No other chief minister has linked it to the Armed Forces Special Powers Act. Not even from north-east and Assam where the Act is in operation like in J&K and from where demands for its revocation from there are also coming. One of the main objections of the Tamil Naidu chief minister Jayalalitha was that States were not consulted in this regard/ "It is surprising that neither the order of the Ministry of Home Affairs constituting the National Counter Terrorism Centre, nor theagenda note circulated to us mentions the gaps and deficiencies in the architecture of counter terrorism capabilities that necessitated the formation of the NCTC," said Jayalalitha. Even Bihar chief minister Nitish Kumar, while expressing reservation about it had said that it amounts to infringing the federal structure where powers of the States and Centre have been defined. "Let me make it clear at the outset that my objections to NCTC are not against the Centre's overall concern at the existing threat to national security by terrorist organizations and the need to strengthen the mechanism to counter it …..I am disturbed to see the sacrosanct principle of federalism being violated in course of Centre's anti-terrorism onslaught," said Nitish at CM's conference. However, Omar had directly linked to AFSPA. "This is likely to have far reaching consequences in our State which is politically sensitive. We have been advocating for revocation of AFSPA..Therefore, mandating/equipping the NCTC with such powers may run counter to our efforts towards the removal of AFSPA at least from certain areas, and can generate avoidable criticism," said Omar. The reason for Omar raising bogey of AFSPA is mainly for two accouts. Firstly even after the Durbar had opened in Srinagar, he had not been to convince the Centre for partial revocation of AFSPA from some districts, which he had been demanding for quite some time. This despite the fact that even home minister is supportive of him on this issue but he himself hasn't been able to convince his colleagues in the Centre. Omar by raising the issue of AFSPA has expressed his displeasure to home minister. The second reason being that the recent supreme court judgment on AFSPA has virtually come as a set back not only for him but for separatists also. The SC by virtually upholding the Section 7 for the Act, has made it quite clear that prior sanction of Centre is needed for initiating proceedings against security personnels, has not only set the records straight but would make it extremely difficult for political parties to call it draconian law. The SC ruling had only strengthened the case of Army, which Omar had himself said is the only agency not backing revocation of AFSPA. |
