Petition seeking grace marks in MBBS Course dismissed

Jammu, May 7 : In a petition filed by Gafoor Ahmed and other who are undergoing MBBS Course at Government Medical College,Jammu. They could not, however, pass the MBBS Final Professional Part-II Examination (subsequent Session), having failed to clear Clinical (Practical) in Obstetrics and Gynaecology securing 24 out of 50 marks, i.e., 1 mark less than the requisite marks. Their representation to the University of Jammu for allowing them one grace mark, having yielded no results, they have approached this Court seeking quashing of Statute 6.2 of the University Statutes governing the Degree of Bachelor of Medicine and Bachelor of Surgery (MBBS), which was introduced to the Statutes vide University Council Resolution dated February 25, 2008, and for a Command to the University to grant them the benefit of one grace mark in Clinical/ Practical of Paper-III. Justice JP Singh after hearing Sr. Adv DC Raina with Adv Anil Verma appearing for the petitioners whereas Adv WS Nargal appearing for the University respondents observed that the significance of Clinical/Practical(s) prescribed for passing the concerned subjects of a Medical course is of utmost importance. The Statute in question of the University of Jammu, therefore, appears to have been enacted additionally in the larger interests of the Society not to permit award of MBBS Degree to those who fail in Clinical/Practical(s) prescribed for the subjects. Award of Degrees to those who do not achieve minimum prescribed marks in Practical may not serve the interests of the Society which needs only those medical professionals who are found fit by the Medical Institutions to undertake the Medical profession. With these observation the petitioners' Claim to the grant of one grace mark in Clinical/Practical) Paper-III-Obstetrics and Gynaecology and challenge to Statute 6.2 of the Statutes governing the Degree of Bachelor of Medicine and Bachelor of Surgery (MBBS), is prima facie found shorn of substance and dismissed.JNF
